Data and Privacy Policy

MidStates VRS is committed to providing customers with the best products and services, both in the field and online. We also recognize and respect your privacy and are committed to protecting your privacy. We created this Policy to communicate our privacy and data policies to our customers. The practices described in this Policy apply to information gathered by us or our subsidiaries and affiliated companies.

1. WHAT IS COLLECTED. MidStates VRS collects both Customer Data and Machine Data (collectively “Data”¬Ě) as described in this Policy.

Customer Data is information that can be used to identify, locate or contact you. MidStates VRS collects the following types of Customer Data:

  • Contact information that allows us to identify and to communicate with you, such as your name, phone number, username, mailing address and similar information.
  • Relationship information that helps us understand who you are and what you want in order to offer you products and services that may interest you, such as your business, location and other demographic information.
  • Transaction information about how you interact with us and our business partners, including purchases, inquiries, and customer accounts.
  • Information needed to complete your equipment and parts purchases, such as your financial and credit card information.

Machine Data is data generated by, collected by, or stored in your equipment or any hardware or device interfacing with your equipment. Machine data may include the location of your equipment, the number of engine hours of your equipment, data regarding equipment operation and equipment diagnostic data, as entered into machines and/or hardware devices interfacing with your equipment. The types of information we collect and share depends on the products or services you purchase, license or access from us or third parties. We encourage you to notify all personnel who use any of your equipment that their use and location may be remotely monitored.

2. HOW MIDSTATES VRS COLLECTS YOUR DATA.

Directly From You. We collect Customer Data directly from you. We will ask you for Customer Data (e.g. contact information and relationship information) when you interact with us, such as when you make a purchase. We may collect additional information from third party data suppliers to help us better understand our customers. We also collect Customer Data when you contact us, such as for customer service purposes.

From Our Business Partners. When you purchase or lease a product or obtain financing, we collect Customer Data (e.g. transaction information and financial account information) from our manufactures and financial affiliates. We may also collect Customer Data from third parties (such as when we obtain credit information or need to verify information that you have provided) in order to complete your purchase or assist in securing financing.

From Your Equipment. If your equipment settings allow it, we collect Machine Data directly from your equipment or it may be delivered to us by third parties, such as through Caterpillar’s Telematics system.

3. HOW MIDSTATES VRS USES DATA. MidStates VRS uses Data for a variety of purposes including, but not limited to the following:

Customer Service. To fulfill orders for products or services and for other services related to your order, such as product delivery, maintenance, warranty service, financing, leasing, and credit services.

Product and Customer Support. To provide support, including monitoring and
managing the health of your machines, to deliver upgrades and product improvement program communications, and for diagnostics and repairs, product safety and recalls.

Marketing. To provide you with communications and offers for products and services from MidStates VRS or our dealers, suppliers and partners, including offers based on your interests, personal and business characteristics and location.

Surveys & Promotional Events. To administer surveys, sweepstakes, contests, loyalty programs and other promotional events.

Communications. To provide you with information that may be of interest, such as Midstates VRS news, manufacturing company magazines, catalogs, announcements, reminders, and technical service bulletins.

Manage Our Everyday Business Needs. To mange things such as payment processing and financial account management, product development, product safety, contract management, website administration, order or contract fulfillment, analytics, fraud prevention, corporate governance, reporting and legal compliance.

4. SHARING AND USE OF INFORMATION.

We may share your Data with our affiliates, suppliers, vendors, and/or their agents and employees as we deem necessary for the provision of goods and services to you. Specifically, we may share your Data: (i) with the manufacturer of your equipment; (ii) with third parties assisting us in the provision, administration, and management of goods and services generally; (iii) with third parties that assist us in providing goods and services that you request; (iv) with third parties that support our business operations or provide marketing or advertising services on our behalf, including marketing, technical, accounting, legal or other professionals; and (v) as otherwise permitted by law or approved by you. We may use your Data for our general business operations if it is in a form that is not capable of being personally identified with you or if it is combined with Data from one or more other customers in aggregate form that does not personally identify any particular customer.

5. CONFIDENTIALITY, SECURITY AND STORAGE OF DATA.

Except as otherwise provided in this Policy, we will keep all of your Data that personally identifies you (e.g., your name and address) as private and will not share it with third parties, unless such disclosure is necessary to:

  • Comply with a law (or based upon our good-faith belief that disclosure is necessary to comply with a law);
  • Protect our rights or property; or
  • Enforce this Policy or any of our other policies and guidelines.

We will not sell your Data to third parties.

We use a variety of commercially reasonable security technologies to help protect your Data from unauthorized access, use, or disclosure. However, the use of such security technologies is not, and should not be considered to be, any type of guarantee or warranty by us that your Data will not be accessed by third parties, or that we will use all available security technologies to prevent unauthorized access to, use, or disclosure of your personally identifying information.

6. PRIVACY PRACTICES OF THIRD-PARTIES.

We cannot control and therefore are not responsible for the data privacy policies of third parties who may obtain your Data. You are encouraged to review the data and privacy policies and practices of any third parties who may have access to your Data. To assist you with this, our website may contain links to other websites, including links to the data and privacy policies of third parties, such as the manufacturers of your equipment, who may have access to your Data.

7. UPDATES AND CHANGES TO POLICY.

We reserve the right, at any time and without notice, to add to, change, update, or modify this Policy by posting such addition, change, update, or modification on our website. Any such addition, change, update, or modification will be effective immediately upon posting on our website.

INTERNET PRIVACY

Browsing our Site
When you visit our website to view any pages, read product information, or use our online tools, you do so without telling us who you are and without revealing any personal information. While we do not collect identifying information about visitors to our site, we do use standard software to collect information for the strict purpose of tracking activity on our site. This allows us to better understand how many people use our site and which pages and features are most popular. To evaluate the usefulness of our site, we may gather and analyze data regarding usage such as:

Regular non-encrypted Internet e-mail is not secure. Our website is not targeted or marketed to children under the age of thirteen.
